A website listing, indicative price or preliminary quotation is an invitation to place an order, not an unconditional guarantee of availability. An order acknowledgement confirms receipt only. A contract is formed when Lumetra expressly accepts the order in writing or issues an order confirmation identifying the accepted products, price and fulfilment terms, subject to mandatory consumer law. Lumetra will promptly explain and reverse any payment taken for an order it cannot accept.

Prices are in Kenya shillings unless stated otherwise. The checkout or quotation will identify whether VAT is included and disclose applicable delivery, installation, processing or other charges before the customer commits. Any subsequent price adjustment requires customer approval, except where expressly permitted by law or an agreed pricing formula.

Dimensions, finishes, grades, batch numbers, product codes and compatibility requirements should be checked before ordering. Photographs and display samples may not reproduce every shade or texture accurately. Material differences that affect the agreed specification will be disclosed for approval; Lumetra will not substitute materially different products without consent. Customers should communicate intended uses and unusual site conditions before purchase.

Customer-provided dimensions and drawings are used as supplied unless site verification is included in writing. Lumetra will identify apparent inconsistencies it reasonably discovers but does not assume responsibility for undisclosed site conditions or design information it was not engaged to verify. Signed or electronically approved specifications govern fabrication, subject to correction of Lumetra’s own errors and applicable statutory rights.

Delivery and completion dates will be confirmed in writing and may depend on supplier availability, site readiness, approvals and payment milestones. Lumetra will notify the customer promptly of material delays, give a revised estimate and discuss lawful remedies where delay substantially affects the contract. Neither party is liable for delays caused by events beyond reasonable control to the extent permitted by law, but payment and refund rights remain subject to applicable law.

Website text, imagery, layouts and trade identifiers may not be commercially reproduced without permission, except as permitted by law. Customer-provided drawings remain subject to the rights of their owners; the customer warrants authority to provide them for quotation and fulfilment.

Lumetra remains responsible for its own contractual obligations and for acts of subcontractors to the extent required by law. Neither party is responsible for losses caused by the other party’s breach, misuse or unauthorized alterations except as the law otherwise requires. Any agreed commercial limitation of liability must be reasonable, expressly stated in the applicable contract and must not exclude fraud, deliberate wrongdoing, personal injury caused by negligence, or non-excludable consumer remedies.

These terms are governed by Kenyan law. Parties should first use the complaint procedure below; either party retains the right to approach a competent court, regulator or other lawful dispute-resolution forum.
